Introduction

FPG Inc., its subsidiaries, and affiliates (collectively, “Floating Point Group,” “FPG,” "we," or “us”), welcome you and acknowledge the importance of your privacy. We treat the privacy and security of your data as one of our prevailing ongoing priorities. Our goal is to provide you with exceptional service and in doing so, we'll share transparently how any of your data may be used to achieve that end. This Privacy Policy covers the data we collect via www.floating.group, our products, services, and any other website that references this Privacy Policy (collectively, the "Services"). When you use the Services, we collect a variety of data, including your Personal Information (any identifiable information) and your Usage Information (how you used the Services).

  • Device Information – We may collect your (1) device type, device identification number, geo-location, time zone, language setting, browser type, and IP address, and (2) from third parties for purposes of transaction processing, identity verification, fraud detection or prevention and other similar purposes.

  • Identification Information – first name, last name, street address, email address, date of birth, and SSN (or other governmental issued verification numbers).

  • Company Information – various information about your company, such as what it does, where its located, and its intended use of the services.

  • Financial Information – bank account, routing numbers, and digital currency wallets that are linked to your account with Floating Point Group.

We collect the following types of Usage Information:

  • Digital Currencies - The currency pairs that you ordinarily trade through the Services

  • Trading Data - The volume and frequency with which you trade through the Services.

  • Execution Costs - The associated costs of your trading, including fees and slippage.

Before permitting you to use the Services, we may request additional information when required by law or under terms of a contractual agreement between you and Floating Point Group. This will most often be used to verify your identity, address or other information or to manage risk and compliance throughout our relationship. We may also obtain information about you from third parties such as identity verification, fraud prevention, and research services.

Our Use of Collected Information

We collect Personal Information and Usage Information in order to provide you and our other customers with a safe, secure, and compliant experience.

 

We may use your data to:

  • provide the Services and customer support you request;

  • open accounts, perform background checks, perform transactions, prevent fraud, report to the Department of Treasury and Financial Crimes Enforcement Network;

  • send notices about your transactions or your network activity;

  • resolve disputes, collect fees, and troubleshoot problems;

  • prevent potentially fraudulent, prohibited or illegal activities, and enforce our Services Agreement;

  • customize, personalize, measure, improve, and expand our Services;

  • deliver service update notices, account related notices, and marketing based on your communication preferences;

  • compare information for accuracy and verify it with third parties;

  • perform other duties as required by law or regulation.

Sharing Personal Information

We may share your Personal Information with:

  • Payment processors and financial institutions to facilitate the opening of accounts and performing background checks.

  • Regulatory entities such as the Department of Treasury, Financial Crimes Enforcement Network as required for normal use of the Services or when compelled to do so by a subpoena, court order, or similar legal procedure.

  • Service providers who provide fraud detection, identity verification, or similar services on our behalf

  • Companies that we plan to merge with or be acquired by. In the case that such a combination occurs, the new combined entity will follow this Privacy Policy.

Change of Purpose

We will only use your information for the purposes described above. In the case that there is another reason that we would like to use your information and it is within the scope of your use of the Services, we will notify you via email that a change is occurring and describe it in an update to this Privacy Policy.

If we need to use your information for an unrelated purpose, we will notify you via email to explain the use and the legal basis which allows us to do so.

Retention of Data

We may retain your Personal Information for up to 5 years after your last use of the Services and to the extent required to comply with (or we deem it reasonable in light of) any laws or regulations.

Security

We encrypt your Personal Information and Usage Information and grant access to employees strictly on a need-to-know basis as required to provide you with the Services. We maintain advanced and proven safeguards to protect your information, both procedurally and technologically.

Children

Our Services are exclusively for persons ages 18 and older. Use of our Services by those under the age of 18 is in direct violation with our policies and if made aware we have received the Personal Information of a minor, we will remove that information from our records.

Our website may contain links to other sites. Floating Point Group does not control the information collection of sites that can be reached through links from our website. We encourage you to be aware when leaving our site and to understand the privacy policies of each website that collects Personal Information.

International Transfers

Our Services are maintained in the United States. If you are visiting from regions with laws governing data collection and use that may differ from those in the United States, please note that you may be transferring your information to the United States and in other countries around the world. You freely and specifically give us your consent to export and use your information within the United States. You understand that data stored in the United States may be subject to lawful requests by the courts or law enforcement authorities in the United States.

Floating Point Group will collect, use, store, share, and otherwise process your Personal Information in the United States. If you have a different country of residence, we will provide a data processing addendum upon request made to legal@floating.group.

Your Rights

  • To withdraw consent - You have the right to withdraw your consent to our use of your Personal Information collected with your consent at any time. Please note that your withdrawal of consent does not affect the lawfulness of our use of your Personal Information prior to receiving your withdrawal of consent nor does it include information collected that does not require your consent.​

  • To access and change your information - You have the right to request a record of all Personal Information pertaining to you that we hold. In the event that you'd like to access or change your Personal Information stored with us, please contact us at legal@floating.group.

  • To erase your information - You may request the erasure of your Personal Information stored with us by contacting us at legal@floating.group. We will promptly respond and carry out your request, except where it may need to be retained for our legal and regulatory requirements.
